Chairman Wheeler has named Thomas Power of CTIA and Christopher Murphy of ViaSat as Chair and Vice Chair, respectively, of the WRC-19 Advisory Committee. We've worked with Chris Murphy extensively before on issues of common interest, and we'll be getting to know Mr. Power real soon. The WRC-19 Advisory Committee is the structure through which United States private sector and non-federal government interests have their say in generating United States positions on WRC-19 agenda items, and its proceedings will occupy much of the Northern Virginia telecommuters' time over the next few years. Chris (and others) I'm comfortable with the way you, the Executive Committee, Officers and CEO have handled a number of tough issues in the past few months. Generally, I would hope that when considering something that is clearly new policy, the Executive Committee would keep the Board in the loop. I'm very comfortable with the EC, etc, continuing to help implement existing policy with the FCC and elsewhere. I'm thinking that in the last six months there hasn't been quite enough communications on a couple of the issues. When you're all working hard on the issues, someone has to step back and make sure we're all still in the same boat. That provision would not be necessary if the EC did not have the broad authority to make policy decisions between Board meetings, but instead had only the authority to execute predetermined Board policies. > >Though Bylaw 40 lists specifically delegated tasks of the Executive Committee, including the duty to â[a]pply existiing Board policy to make decisions between Board meetingsâ that cannot be fairly viewed as a limiting provision but rather an enabling one and an assigned task. The reason is that the broad authority of the EC conveyed by Article 6 cannot be limited by any bylaw provisions; Articles of Association by definition trump conflicting bylaw provisions as a matter of well-established corporate law. Second, Bylaw 40 cannot therefore be fairly read as an exhaustive recitation of the authority of the EC, but rather a listing of enumerated specific tasks that the EC is to do regularly. Finally, it is noted that the third bullet task given to the EC is stated as follows: âAssisting staff and General Counsel in Board recommendations for petitions to the FCC and other governmental and international agencies.â The Board has approved our legislative initiative aimed ! at the United States Congress. We are attempting to implement it. This requires support from the Board on a near-real-time basis. In a true short-fuse situation, our normal procedure would be to consult with the President and the CEO, pursuant to Bylaws 31 and 35. Where time permits, we would normally consult by e-mail with the Executive Committee. Presumably, if the Executive Committee feels that any aspect of our strategy for enacting the Parity Act called for referral to the full Board, they will do so. > > >If the Board is not satisfied with the foregoing interpretation, it is respectfully requested that the Board clarify Article 6 and Bylaw 40. It will not do to draw actions of the Executive Committee into question or to create any impression that the Executive Committee may have exceeded its authority. Upcoming In-Person Meetings and Events CEO Office Reported by Tom Gallagher, NY2RF The Publishing Committee held an extensive teleconference with Kai Siwiak, KE4PT, the editor of QEX to develop a support plan for the publication and its new editor. Steve Ford, Becky Schoenfeld, Bob Inderbitzen, Yvette Vinci and I were attending. Lab Reported by Ed Hare, W1RFI Product Review Testing Bob Allison and a QST Product Review author worked out the last performance details of an SDR transceiver. With the help of Bob and his test data, the manufacturer made several changes to make the transceiver more usable. Yet another software defined transceiver is on Bob's bench that had to be updated first before testing began. Testing is going smoothly at this point, but there may be another software revision soon, which will require some retesting of the SDR. ARRL Web Zack Lau uploaded the propagation forecasts for August. The predicted solar flux is 81. RFI Mike Gruber, Pete Turbide, and Bob Allison located two sources of noise in Coventry while testing a demo model of the new Radar Engineers Model 243. The power company has been notified. A follow-up visit concerning RFI from a funeral home in Rocky Hill was not needed-just before the scheduled visit the noise went away. Central Division Director Dick Isely, Vice Director Kermit Carlson, ARRL Counsel Chris Imlay, Mike Gruber, Bob Allison & Ed Hare discussed a number of EMC and FCC issues in a meeting. Mike Gruber made numerous additions to the RFI Web pages. One of them includes an information pamphlet that hams can give their neighbor in the event of an RFI issue. By typing in certain information on a cover sheet, the information is automatically inserted into the document in the appropriate location. Thanks to Dave Cole, NK7Z for his assistance in this matter. Mike Gruber helped EMC Committee Chairman Kermit Carlson prepare the EMC Committee report. Mike Gruber assisted Rick Lindquist in writing a news story about an FCC notice concerning RFI from LED lightbulbs. QST Zack Lau obtained some screen shots of FLdigi in PSK31 mode with his home station. Bob Allison found that using W1HQ was impractical due to the high noise level and frequent operations during the day from W1AW. Historical Committee Bob Allison, and volunteers Mike Marinaro, WN1M and Jonathan Allen, K2KKH, met with the ARRL Historical Committee, consisting of Midwest Division Director, Rod Blocksome, KØDAS (chairman of the committee), Southwestern Division Director, Dick Norton, N6AA and New England Division Director, Tom Frenaye, K1KI. Mike Marinaro did an excellent job giving the committee members a tour of the Historical Collections. The next task for Bob, Mike and Jonathan is to create the ARRL Heritage Museum, a virtual museum, hosted on our web site. This virtual museum will be a valuable membership benefit with a very low startup cost. Sales and Marketing Reported by Bob Inderbitzen, NQ1R Diane Petrilli reports that an e-mail encouraging hams to join ARRL and upgrade their license class, and an e-mail sent to non-ham users of ARRL Exam Review for Ham Radio (our online review and practice exam resource) have returned over 50 new members so far. Other e-mails to all lapsed members will be sent over the next two weeks. Jackie Ferreira has been working with Sue Fagan as Sue completes the cover designs for the upcoming new editions of The ARRL Handbook and The ARRL Operating Manual. She also prepared a handful of targeted e-mails promoting publications and products. Yvette Vinci prepared a reminder emailing to members with a summary of "What's trending" in August QST, taking advantage of some early analytics shared by Alli Barbieri. The notification was sent to 121,545 members on Tuesday, July 19. Bob Inderbitzen teleconferenced with our new account representative for the ARRL Visa Card program at US Bank, the creditor and issuer of the credit card. John Proctor fulfilled a mailing list for an upcoming mailing promoting the card, which will be mailed by US Bank. Earnings to ARRL have been above average this year; $23,511 for the first 6 months for royalties, new cards, and card renewals. The majority of new accounts are attributed to our own marketing and promotion of the card by email and via traffic to our website. In June, we earned our highest one-month payment since the program inception in 2005: over $6K. Did you know?...in 2015, ARRL fulfilled orders to 67 countries. Field Organization/Public Service Team This past week, a radio amateur from Northern Florida completed requirements to become an Official Observer. Chuck Skolaut compiled and forwarded the monthly Official Observer Summary to all Official Observers, Official Observer Coordinators and Section Managers. Lou Everett, WA5LOU, was appointed as the new OOC for Indiana. A report of unlicensed fishermen using a 2 meter repeater in Maine was received, and OOs are checking on it. There was also a report of a bootlegged call sign being used on a 440 machine in Western Washington. Chuck sent out OO supplies, and he also conducted a morning code practice run at W1AW and hosted two guest operators at the station. Leona Adams received and handled nominating petitions from four incumbent Section Managers who are candidates for new terms of office starting January 1, 2017. The petitions are from Skip Arey, N2EI (Southern New Jersey), Tom Dick, KF2GC (Northern New York), Cecil Higgins, AC0HA (Missouri) and Darrell Davis, KT4WX (West Central Florida). The reports on ham radio licenses being revoked by The Supreme Council of Radio and Television (RTUK) are unconfirmed and speculative. RTUK is not a regulatory body of ham radio. We believe that it is against ham radio ethic to share unconfirmed information, especially in this sensitive time. *MEMORANDUM* *To: Officers, Directors and Vice Directors* *Copy: Sean Kutzko; Rick Lindquist* *From: Chris Imlay, W3KD* *Re: FAA Reauthorization Act, H.R. 636; Painting and Lighting of Short Towers* *Date: July 19, 2016* _____________________________________________________________________________ Greetings. Briefly at the Board meeting I reported the recent passage of H.R. 636, the FAA Reauthorization Act. We were blindsided by the provision in this Bill instructing FAA to enact rules similar to statutory provisions that we have been dealing with at the State level which we collectively refer to as “crop duster” statutes. States, principally western States, have in the past few years enacted statutes attempting to protect meteorological evaluation towers. These are between 50 and 200 feet. They are typically located in rural agricultural areas and they tend to be very low-profile towers, hard for crop dusting aircraft to see in certain circumstances. We had been of the view that these statutes were preempted by FAA’s exclusive authority over aviation safety, even though, in areas not near airports or heliports, FAA did not typically regulate towers less than 200 feet in height. We have made some efforts with the help of TKG to ask FAA to clarify its jurisdictional intent but they have been reluctant to do so. Now, they don’t have to, because Congress has instructed FAA to develop regulations to protect these towers. This is good and bad at once; it is good because this will stem the tide of State cropduster statutes, some of which exempt Amateur antennas and some of which do not. Some of the State statutes are more onerous than what Congress has just enacted. On the downside, this legislation does not exempt Amateur Radio. Had we heard about it earlier, we might well have been able to influence an Amateur Radio exemption through contacts on the Hill that TKG, and *especially* good contacts that Frank McCarthy has in this area. It is unclear why our legislative monitoring key word service, which ARRL HQ deploys, did not tip us off to this earlier. That said, however, the legislation is not that bad as regards application to Amateur antennas, and we will also have an opportunity to influence the final FAA rules by participating in the rulemaking process. We will soon have meetings with FAA which will help clarify their intentions and bring our concerns to FAA ahead of time. The following is a summary of the Bill’s provisions regarding tower marking: 1. Within 1 year after the date of enactment of the Act (i.e. by next July), FAA must issue regulations to require the marking of the towers covered by the legislation. 2. The marking required will be painting and lighting in accordance with current FAA guidelines (i.e. the Advisory Circular issued December 4, 2015). 3. The new rules cover towers constructed on or after the effective date of the rules, and towers constructed before the effective date of the new rules will have to come into compliance within a year after the date of the new rules. 4. Covered towers are those which are “self-standing or supported by guy wires and ground anchors”; which are 10 feet or less in diameter at the above-ground base, excluding concrete footings; are between 50 feet above ground level at the highest point and not more than 200 feet above ground level; which has accessory facilities on which an antenna, sensor, camera, meteorological instrument, or other equipment is mounted; and is located outside the boundaries of an incorporated city or town; or on land that is undeveloped; or used for agricultural purposes. 5. Towers that are excluded are those: (a) “adjacent” to a house, barn, electric utility station, or other building; (b) within the curtilage of a farmstead; (c) which support electric utility transmission or distribution lines; (d) wind-powered electrical generators with a rotor blade radius that exceeds 6 feet; or (e) street lights erected or maintained by a Federal, State, local, or tribal entity. 6. The term “undeveloped” land means a defined geographic area where the FAA determines low-flying aircraft are operated on a routine basis, such as low-lying forested areas with predominant tree cover under 200 feet and pasture and range land. 7. FAA will develop a database that contains the location and height of each covered tower which can be used only for aviation safety purposes. It may not be disclosed for purposes other than aviation safety. While it is a fair concern that exemption language such as the meaning of the word “adjacent” to residences and buildings is undefined, the Bill says that the FAA will provide a definition. We do not anticipate that a large number of Amateur towers will be subject to these rules but there is a good deal of concern about it. We also have an NTSB document isolating the problem calling for a solution as being limited to meteorological evaluation towers. We will provide a briefing memo for inquiries you receive in the near term. Until then feel free to use the above summary of the Bill as material for any response you need to provide.
