RE: Bill of Cost - ARRL -vs- FCC

Greetings, A bit of good news on a Monday morning. You may recall the email below from May 1, 2008. I'm very pleased to report to you, via Chris, that the court has ordered FCC to pay our bill of costs for $6096.18. While this isn't a significant amount of money Dave points out, correctly, that an added benefit is the Court's decision is a reaffirmation that we substantially prevailed because the FCC has been saying we didn't. The courts order is attached for your reference. 73 Joel W5ZN _____ From: Joel Harrison [mailto:w5zn@arrl.org] Sent: Thursday, May 01, 2008 8:06 PM To: arrl-odv Subject: Bill of Cost - ARRL -vs- FCC Dileep Srihari from WilmerHale called Chris today and asked if we wanted WilmerHale to prepare a bill of costs against the United States. This is provided for by Rule 39, Federal Rules of Appellate Procedure. We are not exactly entitled, but are likely to be awarded costs of copying the Joint Appendix, because we substantially prevailed in the case, and got the remand. Dileep thinks that we have a very good shot at being awarded costs of copying, which ran well over $7K, because we got the remand from the Court. Dileep asked Jon Frankel if we should be entitled to an award even though the decision was split on the issues remanded. Jon thinks that we should be able to get a Bill of Costs granted and Chris does as well. Dave and I have given Chris approval to have WilmerHale prepare one. 73 Joel W5ZN

Hi - If anyone has a late flight out on Sunday, or will be staying in the Hartford area after the Board meeting, you're invited to lunch next Sunday at our house in the woods. The current plan is to have some fresh local corn, tossed salad, and BBQ chicken. Looks like decent weather is expected (after 90s on Thurs-Fri-Sat). Sorry for the late notice but we just had our first taste of local corn today - and it passed with flying colors! We're located about seven miles northwest of the airport. I can pick up a few people at the hotel beforehand and return them there or to the airport after lunch.
