Greetings. Attached is a letter ARRL has just now sent to the Air Force Frequency Management Agency, to a person that Paul Rinaldo knows well and who I have come to know well also in recent months on another issue not related to Amateur Radio. This follows a meeting with Mr. Moorefield on March 20, 2007 that Paul and I attended for ARRL. The background of this matter is briefly recited in this letter, but there is considerably more detail about it than is reflected in this memo. I will provide more information to any Director or Vice Director who needs it. This letter was reviewed several times by Directors Frenaye and Vallio, in whose divisions the Pave Paws radars and the allegedly interfering repeaters are located. Upcoming Meetings and Events Program & Servcies Committee April 21 in Newington, CT Regulatory Information We continue to work closely with the ARRL Lab, Counsel and Chief Technical Office on the Pave Paws radar issue and are preparing information that the two involved repeater coordinating groups can share with the affected repeater owners. Working with Rick Lindquist we continue to monitor the status of various pieces of state legislation affecting amateur radio. The governor of Washington passed the leasehold excise tax exemption bill for amateur radio April 10th which become effective July 22, 2007. The amateur exemption for the Washington cell phone bill survived the Senate version and is awaiting action in the House. We handled a routine number of phone calls and emails about license renewals, operating practices, and possible enforcement issues. We have also started work on a short QST article looking at Part 97 after the series of recent changes. Chris Imlay provided us with the text of the two petitions to reconsider 05-235 that the FCC put on public notice. We have also begun work on several PowerPoint presentations for Dayton and a couple of upcoming state / section conventions. Media & Public Relations The new EmComm video PSA for 2007 was completed and will be unveiled at Dayton. The annual report text has been completed and sent on to Production. It now only awaits the auditors final report. We have gone through more than œ of the EmComm brochures, and they are still being requested at high rates of use. Volunteers for the Dayton booth are being sought and plans are in place for the PR forum there. Allen will be on vacation from 4/21 through 4/29. Production/Editorial Congratulations to Khrystyne Keane, who has accepted the position of News Editor. We are advertising for her current position, Assistant Editor. The May/June issue of QEX has been released to the printer. Rick Lindquist reports The ARRL Letter, Vol. 26, No. 15, distributed to 65,704 members on Apr 13. Thanks to Joel Kleinman for handling this on the HQ end, since I was off-site due to illness much of last week. In addition to several news items, briefs and announcements, Rick also submitted "Happenings" for June QST. Rick voiced, edited and produced ARRL Audio News for Apr 13. Thanks to Jon Bloom for handling distribution at HQ. Lab BPL Consolidated Edison (Con Ed) has been operating the BPL trial in Briarcliff Manor, NY. Con Ed is heavily invested in the Ambient Corporation, the involved BPL manufacturer. Nonetheless, in a March 2007 filing with the New York State Public Service Commission, Con Ed announced that (s)ince BPL is still evolving and the Companies evaluation of this technique is in the early stages of feasibility studies, this method was eliminated from consideration in the Companies current business case. The Con Ed BPL system in Briarcliff Manor, NY has been in operation since 2003, so if this is in the early stages of development, it doesnt appear likely that Con Ed will be moving toward widespread BPL deployment any time soon. Ambient has, however, announced that it will be conducting a trial of their 2nd-generation technology on Con Ed underground lines in Manhattan. Ameren UE, the Midwest electric utility that is operating a Main.net BPL system in Cape Girardeau MO, is also a bit gun shy about access BPL. Ameren recently announced that it was partnered with the River City Internet Group to provide broadband to a residential building in St. Louis. The system will use HomePlug protocol, with notches in the ham bands, so it is not likely that there will be widespread interference problems. Although Ameren has been testing a Main.net BPL system in Cape Girardeau, MO for about five years, Cindy Bambini, Amerens BPL project manager, said that Ameren isnt planning to expand the system beyond that test. She said that several regulatory and technology issues need to be overcome before Ameren could start selling Internet access over its power grid. Arizona Power Systems (APS) has announced that it is again seeking a new vendor for its pending BPL trial in Surprise, AZ. MTI, the company that had installed the ill-fated system in Cottonwood, AZ has been sold, and the new owner will not be implementing BPL. APS has announced that is has narrowed the list of possible BPL integrators to five companies. Estimates are that it may be as much as a year before BPL is implemented in Surprise. Here is a list of cities in the US that are found in the FCC-mandated BPL database. One ham noted on a web page that because the labeling on the device indicates that it may cause harmful interference, these bulbs are surely strong RFI sources. The Lab obtained the several brands that are on sale at Wal-Mart and Home Depot. When tested, they measured about 30 dB lower than the applicable Part 18 regulations. Ed hooked up the Labs calibrated loop antenna and turned on a bulb a few feet away. He didnt hear its noise until he stuck the bulb inside the loop. The Lab has a report from a ham that notes that some of these bulbs were dead quiet, but other models were extremely noisy. The Lab is buying a few of the noisy ones and will test them for compliance and for interference. Presentation for the FCC Mike Gruber is working with Mike Martin to do a presentation on power line noise for the FCC. On the Air Activities On a personal note, Mike Gruber participated in the Titanic Special Event station W1MGY at the Titanic Historical Societys Museum. Thanks to Rick Lindquist for the added publicity, which helped make the event a great success. The event was well received and commemorated the 95th anniversary of the Titanics fateful voyage. Membership & Volunteer Programs Contest Branch The final editorial and layout touches to the 160 Meter and SS Phone Contest results columns are now in the works. The 10 meter electronic logs and data came in on Monday. The data was combined with the paper records and was shipped off to Ken Harker, WM5R, the column author for the 10 Meter Contest Results column. Also on Monday, Jay Townsend, WS7I, submitted his writeup for the 2007 RTTY Roundup Contest. This week, 115 pounds of cards were received from members. W1AW Andrew Toth and Peter of XX Towers Inc. were on hand Monday (4/9) to perform the Spring antenna/tower work inspections. In addition, the balun on the rotatable 17-meter antenna was replaced; the preamplifier used for the 70cm Satellite antenna was bypassed since the preamp appeared to have failed; the two 20-meter fixed yagis were realigned to improve on coverage; and the rotator on the North tower was repaired and replaced the same day. Andrew also installed a side-arm on the HQ station W1HQ tower. Greg Kwasowski installed an access panel in a wall in the upstairs conference room. This now allows for easier access to the conduits running up from the basement. He also installed the wiring (using Romex) for the Test BPL fixtures in the upper conference room. Joe updated the web code practice files and their archives. He processed five Qualifying Run certificates. Joe also processed regular W1AW QSL card requests. He replaced the aging Ten-Tec Omni VI+ transceiver that was being used for the 80-meter broadcast transmitter with a Ten-Tec Orion I. Joe installed the fourth Icom IC-756ProII transceiver for use as the 40-meter broadcast transmitter. Joe also repaired the North tower rotator. Scott worked on slow and fast code practice files for the latter part of the month of April. Scott also assisted the DXCC department with checking 298 (database-inputted) cards against DXCC applications. Field Organization/Public Service Team Under the leadership of Victor Madera, KP4PQ (now former Section Manager) and new Puerto Rico Section Manager Roberto Jimenez, KP4AC, the Puerto Rico Section recently organized and sponsored a successful training workshop for new Official Observers. Chuck Skolaut, at HQ, received several complaints about a bulletin-like broadcast heard on 14275 kHz. Documentation was received, and it will be evaluated. Also, a number of questions were received regarding proper identification, the use of tones, and about repeaters that are being set up in the simplex portion of the band plan. Leona Adams recently e-mailed Section Managers copies of their latest Field Organization Appointment roster from the HQ data base. Upon reviewing these, the Section Leaders have a chance to compare records, and they have been updating Leona with new or changed information. In addition, new appointments have arrived and over 20 initial supply packages have been sent. Filled-out New Hampshire Section Manager ballots are now arriving at HQ. Field Organization Leaders from around the country are reporting their March activities to Steve Ewald at HQ, and monthly Section News reports are going out. Editorial work on the June QST Public Service column is in process. Education Services Contact was reestablished with instructors via a newsletter. We have had many follow-up contacts with instructors calling and emailing to report what they are doing and making suggestions. We are working on setting up a new process for fulfillment of orders of recruiting materials that will take this function out of the education department. Debra met with American View Productions to discuss coordination of resources for development of the Technician video course. The Teachers Institute participants have been setting up travel arrangements for the summer activities. Mark completed first attempts at script writing for a couple of the opening lessons for the Tech course DVD. Greetings, Following the boards approval to proceed with the withdrawal of our RM-11306 petition, here is how I plan to proceed. 1. Chris and I are preparing a draft news story. Dave is returning from Ireland where he attended the 75th anniversary of the Irish Radio Transmitting Society and will be back in the office Tuesday morning, April 24. After his review and input on the draft (which I expect Tuesday) we will send it to ODV for Director review. This story will indicate that we are withdrawing the petition for further review to address comments in recent months, that the Board will discuss the matter in July with the intention of refilling the petition at some point in the future. We will emphasize the public solicitation that occurred previously with this petition, review its history and dispel some of the flagrant lies that have been flying rampant over the past few days. When it is complete it will be posted on ARRLWeb. 2. We will file the necessary paperwork to withdraw the petition the next day. 3. We will then begin a series of web stories to educate people on the facts behind regulation by bandwidth. 4. Between now and July, I want to strongly encourage each of you to study this matter, ask any and all questions you may have. Talk to the members in your division. Make sure they understand the facts regarding this matter. Seek their input. Be prepared to come to the July meeting ready to resolve this matter. 5. At the July meeting, we will dedicate as much time as needed to resolve this matter, possibly the entire day Saturday. It is my expectation that we will depart the July meeting with a clear understanding of this topic, the issues and what our future course will be. Again, I can't stress enough that we all invest whatever time is required to fully understand the technical basis for regulation by bandwidth, resolve any questions you may have in your own mind, and come prepared to resolve this matter. Dave, Chris, Paul and I will provide any background our technical information you desire. Remember, this is NOT about WinLink, although WinLink is currently a major issue when regulation by bandwidth is discussed. Please understand the difference and resolve those issues in your own mind. If you have any questions about on-the-air WinLink operation, you may want to chat with Dick Norton. Dick conducted a WinLink experiment at W1AW with Joe Garcia on Friday prior to the PSC meeting and his verbal report was educational to me for some aspects of WinLink. But again, please ask any question if you don't fully understand the issues. Again, I can't encourage you strongly enough to spend the next three months resolving any issues you may have in your own mind regarding regulation by bandwidth. "On motion of Mr. Isely, it was unanimously voted to recommend to the Board the adoption of the following resolution, in accordance with Article 6 of the Articles of Association: Resolved, that RM-11306 be withdrawn in order to permit a full discussion and consideration of options at the July meeting of the Board." The vote was 14 in favor, 1 opposed. Frank, A teleconference for what?? The only teleconference I'm aware of that was schedule recently was the Executive Committee a few days ago concerning RM-11306 that I was on, although there may have been other committee teleconferences scheduled. Just a couple of points in response to Dick's thoughtful comments, if you will: The problem with the 1300 negative comments isn't so much that the FCC is "caving in" to "only" 1300 commenters among 680,000 hams. It is that the 1300 comments were almost universally opposed to the proposal, which was after all a bare petition, not an FCC proposed rulemaking. One can't blame the FCC here, because they are, I am thoroughly convinced, attempting to be supportive and help us sell this concept. The trouble is that in order to survive a challenge to an FCC NPRM proposal to go forward with some form of regulation by bandwidth, and avoid a very easy argument that the FCC's action would be arbitrary and capricious, the FCC needs something positive on which to hang its hat. The record isn't there. And the fact is, the record has in it large groups of comments not relevant to the amended proposal, and some comments based on misconceptions about what is being proposed in the amended proposal. So FCC has a bad record. It is reasonable, and not mere chicanery, for FCC to want us to consider starting over again, to create for them a clearer record, and something on which they can base a proposal to go ahead with the concept that we want to go ahead with. Eliminating confusion, some caused by us, much more caused by doomsayers, false prophets and sophists such as Skip Teller, is a good opportunity. 1300 comments on a bare petition for rule making is very very large. It is not a small smattering of comments. Compare this to the first no-code rulemaking, an FCC NPRM. There were 5,000 comments filed on that, admittedly at the time paper ones. This is not a situation like that in 04-140 or 05-235 where FCC thought it knew more than we did about what is good for the Amateur Service. Joel has apparently turned that around. This is a different day, a different proposal, and one that wasn't popular when we first filed it. To some extent, it is likely to be a "damned if you do, damned if you don't" plan in the future as well. But consider case by case solutions to regulatory proposals rather than systemic ones, because a topic like regulation by bandwidth is a difficult sell no matter what we do, and therefore not evidence of a problem we have in marketing other proceedings. At the EC teleconference after the completion of Chris Imlay's review, I asked about the number of negative messages the FCC received first on the "full draft" RM-11306 and then on what I refer to as our truncated proposal. The estimate given was a total of about 1300 negative messages. This number can be adjusted one way or the other, but what struck me is that the FCC's position on RM-11306 is being driven by only 1300 negative messages from 600,000+ Amateur Radio Service Licensees! And because the commission is caving in to this very small minority, we are being forced to salvage the situation by using a legislative technicality in order to expunge this negative message record. We are being forced to keep the Wizard of Oz's secret of the man behind the curtain. In spite of my disgust with this situation, I authored the motion recommending to the board that it withdraw RM-11306 from consideration at this time. We will then tweak, re-draft, or otherwise re-configure this proposal and file it again. However, I expect we will have a major backlash from what up to now has been the so-called silent majority. I do not like the situation we are in on this proposal. Yes, we failed to sell it to the amateur radio community. But the FCC also shares some of this blame and we cannot express this fact outside of our board family, if we really want regulation by bandwidth to become the way our amateur bands are managed. Jim and Jay are correct. We must make sure we are all in total agreement on a revised proposal, a plan of action to sell it, and our enthusiastic individual willingness to then sell it. If we fail in any of these three steps, we are wasting our time and the ARRL's credibility.
