My RPV case is rather different, and essentially unique. There is another RPV case now going on in which the normal principles, as you well enunciated them, would apply. If my friend down the road wants to allow commercial unit on his tower, what's the problem? It keeps one more tower from the neighborhood, and that's good. To allow a Doctors' paging service to use an amateur tower seems ok to me. Now if the commercial unit could not locate in the area for some reason that's a different situation. Let's assume a ham sells his place to a non-ham and takes his antennas down but leaves his tower. Certainly the non-ham can continue to maintain the tower (SWL, scanning OR continue to rent space on the tower to the Dr's paging service). If there is an ordinance prohibiting such activity once the ham moves, the new owner must comply. Likewise if the form7er ham owner had rented space and that was against the ordinance, then there would be a problem with the authorities. I'm troubled with the notion that a ham tower cannot be used for anything except amateur radio. Again if there is some prohibition against the commercial use, then follow the law. In my opinion, the installation ceases to be a purely amateur installation as soon as is used to perform any commercial function. If the commercial installation cannot meet the criteria of the local ordinance on its own merit the preemption available to amateur installations CANNOT be used to bootstrap approval of a co-located commercial installation. The critical question is would the commercial activity be permitted if the Amateur equipment was removed. I am genuinely concerned that if a "bootstrap" argument is accepted in a community any future Amateur applicant will be viewed as a "shill" or "front" for a commercial interest. Receiving and reading an email should not allow a virus to infect your computer... as long as you don't click on any of the included links such as "mail to:" or "http://www.gotcha.bad", or click on any attached file... regardless of the name of that file. I understand there are email programs that will automatically open attached files unless you disable this "feature". Unless you know your correspondent AND you are expecting a specific attached file or URL, just read the message text and then trash it. I have a different take on this commercial/ham tower issue. One of our problems is that there are way too many towers (antenna support structures) in Metro Portland and probably elsewhere too. Seems to me someone ought to suggest that at least commercial interests consolidate. We could have several cell companies on one tower and likewise paging etc. on a single tower. Sure there are coverage issues but someone could sure consolidate and cut down the number of towers. I have known hams with commercial paging antennas etc on their towers. To the extent that this prevented another tower for the same thing, I see it as beneficial. In fact the great number of commercial towers around may sways public opinion against us putting up another tower. I suggest that it might be beneficial if a ham were to indicate that he/she were going to collocate some commercial antennas and thus keep more towers from a given area. Art's picture of course goes to the extreme and beyond. I would not be so quick to disparage a ham/commercial tower.
