Two items of interest in today's FCC releases. On the regulatory front, you already know that Expert Linears has petitioned for rulemaking to remove the 15 dB amplification limit for external power amplifiers. They are also seeking a waiver of the limit during the pendency of the rulemaking. The FCC seeks comment on that waiver request in a separate proceeding, with a comment date of August 29. On the enforcement front, the Commission has assessed a $1000 forfeiture against David Tolassi, further to an NAL issued last year. The Tolassi forfeiture is unfortunate in that the fine is so low as to be a non-deterrent. It is, unfortunately, the base forfeiture amount in all radio services set forth in Section 1.80 of the FCC rules for failure to provide a station ID. Why only an ID violation? Because that is an objective rule violation and there is unlikely to be a hearing which might be triggered for a $25K malicious interference violation, for example. The $1,000 base forfeiture amount for a station ID violation has not changed since it was first adopted in 1997.
