[arrl-odv:33405] New Hampshire bill banning wireless facilities in residential areas

Interesting is that they've used the FCC RF exposure limits to justify this. https://www.gencourt.state.nh.us/bill_status/pdf.aspx?id=29663&q=billVersion I assume that Dir. Kemmerer and possibly Fred Hopengarten are on it. Ria

And looking back I see New England is already all over it :) Several of my division’s members have asked as they see it as precedent setting if it passes. Even if there is federal preemption, it may still be a challenge. I’ll be looking with interest to see how this progresses. I know Fred had appeared before the Supreme Court in New Hampshire a few years ago to successfully argue an antenna case that made its way up through the courts there. But that was not a legislative matter. He would not know about this unless someone consults him or asked him to be in the loop now. But I think it will be an expensive fight to have it declared preempted by Federal law if it were to get traction and pass. However, the service carriers have deep pockets and I would think would step up to that plate to fight. Yesterday morning, Rep. Peter Torosain (R-NH), WB1CBY, learned from the chair of the House Science and Technology Committee dealing with HB 1644 that the bill will be sent to Interim Study. Some feel that this effectively kills the bill in its current version. It's still something that bears continued surveillance. 73, Phil Temples, K9HI Vice Director New England On Tue, Feb 8, 2022 at 9:57 AM Jairam, Ria, N2RJ (Dir, HD) <n2rj@arrl.org> wrote:
