Good Morning: Attached is the final draft of the minutes from the January Board meeting for your consideration. This message then, as per Standing Order 11-2.28, is the call for a vote from the Directors to approve the minutes (Yea or Nay). A simple majority of the Board is required for approval. If approved, we will then: *Post the minutes on-line to the ARRL web site; *Distribute a copy to each member who has opted to receive the minutes via e-mail; *Post the news story about the meeting. Please note that the EC will review the story on the meeting prior to it's posting and we will wait to post the final minutes until we can complete all three steps simultaneously. If, for some reason, the Minutes are not approved, we will revise and resubmit them for another vote to approve. The following news item will be posted over the next 24 hours. It is the result of the upgrade and replacement of 18 switches and other network improvements over the course of two days next week. As I understand it, this is the completion of work that was included in the 2019 operational plan. Brief Interruptions of ARRL Headquarters Systems Planned for February 13 The ARRL IT Department anticipates two short interruptions to these Headquarters-based systems: Logbook of the World; Online DXCC; International Grid Chase Archive; National Parks on the Air Archive; Centennial QSO Party Archive, and the W1AW EchoLink Conference Server. The interruptions should occur on Thursday, February 13, between 1200 - 2200 UTC. Each interruption should be less than 10 minutes in length. 73, Barry, N1VXY

Hello ALL - It was my understanding that the roll-out of theBand-planning Committee recommendations wouldbe done through a news story on the League Webpage, along information about the preferred method for members to comment to the Board. The Committee report and proposed bandplan has been posted on the ARRL site, as noted in several of thesocial media sites. But it appears that we have norecommended method of receiving comments andparsing them to the various Division Directors andVice Directors. The nominations were never closed as would normally be the case before President Roderick stated it was a vote to renew the contract. I will admit, there’s certainly some ambiguity here and that’s why we’re having trouble characterizing it. One point that hasn’t been brought up yet but I think should be noted. There were two votes on employee contracts held throughout the meeting. The first at Minute 13 was made public in the minutes. The second at Minute 47 (although it was in the Committee of the Whole) was not made public. This inconsistent treatment of employee contracts is problematic but I’m not sure there’s anything that could be done about this now. The inconsistency could be a problem for the organization if there was ever a legal action, however unlikely. This is not a fight I feel we need to undertake. So far, however, I’ve not seen a clear majority of the Board for either treatment (personnel issue or not). This needs to be resolved ASAP so that minutes can be issued and the meeting story written and published. I’m surprised we’re not seeing a lot of complaints from members at this point. So here’s what I’m going to do. I will present the final minutes for Board approval on Thursday as per our rules. It will treat the matter in Minute 13 as a personnel issue and not include the vote count. This at least presents a similar treatment, although not the same in detail, for both contract matters. That is the version that the Board will be asked to vote on. If the majority does not vote for that final version of the minutes, then I will take that as a decision to include the vote count in Minute 13. Accordingly, I will make that change and reissue the minutes immediately for a final vote. Mickey et al., I had a discussion with Diane and the Bandplanning committee, While a reflector sounded like a good idea at first glance, Diane noted that there were implementation problems with that approach. So we decided that the article would have a link to a place where such comments and questions can be sent. The link will be active for 2 weeks or so, though we could keep it active longer if comments are still pouring in, after which the material will be bundled up and all of it made available to the committee and the Board. All In connection with the recent reported decision of a Hudson Division local governmental unit to burden its citizens with a demand that the use of government facilities be conditioned on proof the facility user carried liability insurance for sexual abuse, the question of whether the ARRL's Affiliated Club liability policy provided such coverage was raised. The explanation of the extent of coverage on the ARRL's website, while helpful, does not address the issue. The broad-based answer to the question is two-fold. First, the Affiliated Club liability policy, per Risk Strategies, the broker for the sale of the policy, does not provide liability coverage for an obligation to pay monetary damages arising from a conviction for the commission of a criminal act. Exclusion of coverage from liability policies — homeowner, commercial, etc. — for the commission of intentional acts, including criminal acts, is nearly universal, so this response is neither unusual nor shocking. Second, per Risk Strategies, the Affiliated Club liability policy carrier, who appears to be Hanover, would tender the cost of a defense (i.e., pay for the cost of lawyers to defend) until the time that a conviction for the alleged defense was obtained. The full exchange with Mr. Scott Brelie, the Account Manager for the ARRL insurance program, is copied below. Mr. Brelie's last comment: "It is always difficult to say if the policy would apply when the facts of what may have happened are just hypothetical" is fair. The devil is always in the details. But, his response does address the critical question of whether liability coverage for sexual abuse is provided by the Affiliated Club liability policy. This came across my e-mail this morning from the NLI affiliated club coordinator, Richie, K2KNB. Apparently, liability insurance for sexual harassment is now required if an event has attendees under 18. This is a requirement imposed by local Government when using their facilities. Has anyone else seen something similar? This adds $1500 to the cost, if anyone under 18 is attending. The choice is to either pony up the $1500 or exclude minors under 18 years. See below: "There is however, a more important change affecting LIMARC and something that may affect you at some point. LIMARC uses a county owned facility that now requires us to have a sexual abuse insurance policy if there is anyone under 18 attending our event. Under 18? There are ham radio operators under 18. The cost of such a policy is at this time approximately $1500 for a three day event. We now have to decide whether to spend that money or forbid anyone under 18 from entering the site.
