It now falls to Harold to report on behalf of the bulk of the Headquarters staff. As you review his report I think you will be impressed with how quickly he has managed to begin making positive changes, particularly with regard to having the staff work together across departmental lines. BPL You will recall that the FCC BPL Report and Order finally was published in the Federal Register in early January, some 11 weeks after its adoption. The delay supposedly was to ensure that the several hundred pages of material that we had requested under the Freedom of Information Act, including the Commissions own field measurements of BPL emissions, would be released prior to publication. This gave us the opportunity to address these documents in our petition for reconsideration but does not, in our view, correct the Commissions procedural error in not making them available earlier. Chris Imlay filed his magnum opus petition for reconsideration on February 7, then followed up with appropriate oppositions to others petitions and replies to their oppositions to ours. At this writing the FCC has not acted on the various petitions for reconsideration. We did not request a stay of the effective date of the new rules since the new rules, inadequate as they are, still represent some improvement on the existing rules. With the departure of Michael Powell from the FCC, BPL has lost its head cheerleader at the regulatory agency charged with protecting licensed radiocommunication services from interference. This doesnt mean that the FCC will do an about-face on the BPL interference issue, but it does suggest the possibility of a fairer hearing than we were likely to get under Chairman Powell. House Resolution 230, introduced by our friend Congressman Mike Ross, WD5DVR of Arkansas, may help. H. Res. 230 calls on the FCC to reconsider and revise rules governing BPL systems based on a comprehensive evaluation of the interference potential of those systems to public safety services and other licensed radio services. Since BPL first reared its head, we have had to emphasize that it is not BPL that we oppose but rather BPL interference. BPL may represent a retrogressive technological step, but that would not be our concern if it did not have negative consequences for radio amateurs and other spectrum users with whom we share common cause. Motorolas announcement on May 23 of its Powerline LV system gave us an opportunity to accentuate the positive for a change. Motorola became the first company to announce a BPL system designed with the need to avoid interference to and from amateur radio stations in mind. Motorola did this by (1) avoiding the medium-voltage (MV) lines altogether, (2) using HomePlug modems (which operate between 4 and 20 MHz and avoid all of the ham bands in that range except 5 MHz) on the low-voltage (LV) feeds to the customers premises, (3) adding hardware filtering of the ham bands for further protection against egress and ingress, and (4) offering as an ultimate fallback the option of substituting wireless for the BPL link. In addition, Motorola was willing to listen to our technical staff during the design process. So, while we have not yet seen the Powerline LV system in operation, we were able immediately to make positive comments about the direction they were taking and to contrast Motorolas approach with that of other BPL companies. One benefit of our positive comments in the wake of Motorolas announcement has been an improvement in communication with Current Technologies, a BPL company that almost has it right at least with respect to amateur radio. Current uses low-band VHF, and says it avoids using HF, on the MV lines. Current uses a HomePlug modem between the pole transformer and the customers premises (like Motorola, but without the additional hardware filtering). Current claims it can avoid specific low-band frequencies that might be in use in their service area and may indeed be able to do so, given that public safety receivers are not generally as sensitive as amateur receivers. However, as far as we know Current has no ultimate fallback in the event of harmful interference to, for example, a serious shortwave listener. Still, Current has been able to avoid major interference problems in Cincinnati, where it is operating the largest BPL deployment in the country, and now sees virtue in talking to us about what they can do to distinguish themselves from the more problematic BPL companies such as Amperion, Ambient, and Main.net. In another positive development, we have learned that the FCC Enforcement Bureau is getting ready to assume responsibility for BPL complaints from the Office of Engineering and Technology. A Web form for filing BPL complaints is being readied. Responsibility will reside in the Spectrum Enforcement Division headed by Joseph P. Casey, KB1YX. Full-scale BPL rollouts are still rare. Here in Connecticut, United Illuminating (UI) the power utility serving the New Haven area is operating a very small BPL trial in Shelton using Amperion hardware. This has given us the opportunity to demonstrate BPL interference to third parties without having to drive very far, since Shelton is about 45 minutes from Newington. Local amateurs filed a formal complaint in mid-June and the company reported making some adjustments, but interference is still present. UI claims it wants to be cooperative, although they have not yet demonstrated much understanding of the interference issue. We will try to arrange some joint tests, including tests of the interference susceptibility of the BPL system to nearby amateur transmitters, in order to educate UI about the pitfalls of BPL. Bandwidth Petition In April the Executive Committee completed its work on recommendations for a petition for rulemaking to regulate subbands by emission bandwidth rather than by emission type. The announcement of the ECs action set off a round of public discussion and debate, including about some aspects of the bandwidth proposal that had not previously generated much controversy. The EC recommendations and a petition drafted by General Counsel Imlay in accordance with the recommendations will be presented for your consideration. One aspect of the proposal that was not initially controversial and has not changed since last August, but that nevertheless has generated considerable recent discussion, is the selection of 3 kHz as the maximum bandwidth (other than the specific exceptions for ISB and AM) for emissions below 29 MHz. Because bandwidth is defined in Part 97 in terms of occupied bandwidth the bandwidth of the signal as actually transmitted this has raised, in some minds, the specter of amateurs having to be able to measure their bandwidth in order to prove they are in compliance. This was never our intent, but it is easy to see why the concern arises if one reads the Part 97 definition of bandwidth: The width of a frequency band outside of which the mean power of the transmitted signal is attenuated at least 26 dB below the mean power of the transmitted signal within the band. The definition is similar, but not identical, to the ITU definition of occupied bandwidth. Another, more theoretical concept of bandwidth is called necessary bandwidth which is defined by the ITU as: For a given class of emission, the width of the frequency band which is just sufficient to ensure the transmission of information at the rate and with the quality required under specified conditions. There is a table of necessary bandwidths for various types of emission in Part 2 of the FCC rules. If in order to be responsive to comments received the Board wishes to consider alternatives to the Executive Committees recommendation with regard to the 3 kHz bandwidth, two possibilities come to mind. Option 1. Adopt a slightly wider bandwidth than 3 kHz, such as 3.5 or 4 kHz. This would easily accommodate everyone except those who wish to push the edge of the envelope. Option 2. Define permitted bandwidth not in terms of occupied bandwidth but rather in terms of necessary bandwidth, remembering that the following two rules should be retained in any case: §97.101(a) In all respects not specifically covered by FCC Rules each amateur station must be operated in accordance with good engineering and good amateur practice. §97.307(a) No amateur station transmission shall occupy more bandwidth than necessary for the information rate and emission type being transmitted, in accordance with good amateur practice. International and IARU My only official travel outside the US in the first half of the year was to Croatia to represent the IARU at a Central European preparatory meeting for the IARU Region 1 Conference to be held in Davos, Switzerland in September. The preparatory meeting happened to coincide with the Region 1 Executive Committee meeting, so none of the Region 1 EC members could attend. It was thought important that an IARU official be present to serve as an information resource, as many of the participants had no prior experience with IARU conferences. The preparatory meeting, which was attended by representatives of 11 IARU member-societies, provided an opportunity to encourage the amateurs of Bosnia and Herzegovina to work together across the lines that have separated them since war broke out in 1992. It also provided a forum for the amateurs of Serbia and Montenegro to discuss the problems arising from the uncertain status of the union of their two republics. While in Croatia I saw a video production about Amateur Radio Direction Finding for the blind and discussed the event with the principal organizer, which led to one of the initiatives discussed in Allen Pittss report (see Annex A to Doc. #9). On the first weekend in March the three IARU officers Larry Price, W4RA, Tim Ellam, VE6SH, and I met at Larrys home in Statesboro, Georgia to begin defining a long-range vision for the IARU. This will be an iterative process over a period of at least a couple of years. Imagining what sort of international organization Amateur Radio should have 20 years from now is the easy part; figuring out how to get there from where we are today will be more difficult. Just before the ARRL National Convention in Dayton I hosted IARU Region 1 President Ole Garpestad, LA2RR, during his first visit to Newington. Around the same time we were also visited by several representatives of the Radio Society of Great Britain. These international visitors went on to Dayton. In the second half of the year I will be attending the following as IARU Secretary: IARU Region 1 Conference, Davos, Switzerland, September 11-16 IARU Administrative Council Meeting, Zurich, September 17-18 IARU Region 3 Directors Meeting, Bangalore, India, October 5-7 SEANET Convention (part), Bangalore, October 7-8 I want to acknowledge the assistance of Dave Patton and Lisa Kustosik, KA1UFZ in minding international relations, which has continued to be invaluable to me. Media and Public Relations Allen Pitts has prepared two documents that are appended [sent separately by email] to this report. The first is the usual report on media and public relations activities. The second is a proposal for a thematic public relations campaign for 2006 based on the word hello. Allen and I are very excited about this concept which, if coupled with the 100th anniversary of the first voice transmission by radio and the hoped-for restructuring of amateur licensing by the FCC, could generate a great deal of positive media coverage and also important make presently licensed amateurs feel good about being hams. Staff Officers So far this year we have held two meetings of the staff officers, including Paul Rinaldo, in Newington. This has led to a better understanding of what each of us is doing and how we can help one another. In Closing thanks to everyone on the Board and staff for their support over the past six months.
