As Congress heads towards an extended Summer Recess (July 26th September 7th), we are left with only 28 days from July 1st to the target adjournment date of October 6th in which Members of Congress will be meeting and voting on legislation. This leaves a very small window of opportunity to pass bills before the end of the 108th Congress. The phrase transition would be a suitable theme for the last several months on Capitol Hill, and the months to come, especially as they relate to telecommunications legislation.
House
Most notable over the last few months has been the appointment of Rep. Joe Barton (R-TX) as Chairman of the House Energy and Commerce Committee. Although, the Chairman has retained most of former Chairman Tauzins (R-LA) Committee staff, he has brought a different dynamic to the legislative priories of the Committee. Having recently served as the Chair of the Energy Subcommittee, Rep. Barton has not been as aggressive on Telecom related issues as Rep. Tauzin was. Most of the telecommunications agenda (which had been primarily set by Tauzin) is now being steered by the Telecommunications Subcommittee Chairman, Rep. Fred Upton (R-MI). Rep. Upton has a broad based agenda. Although he has been receptive to some amateur radio concerns, he is handling a wide array of issues ranging from public safety users, to broad band access, to digital transition. Yet, so far this year, no major bills have been moved by his Subcommittee or the full Committee.
Senate
On the Senate side, regardless of who is in power after the elections, there is a great deal of change of the horizon. Sen. John McCain (R-AZ), Chairman of the Commerce, Science and Transportation Committee (which has oversight of telecom issues) will leave his post at the end of the year because he has reached his term-limit as Chairman. However, with a huge interest in the telecom arena, Sen. McCain has stated his intent to take over the chairmanship of the Communications Subcommittee. He has made clear his plan to review the Telecom Act of 1996 and update it. With this goal laid out, the Commerce Committee has already begun conducting hearings on the topic in anticipation of legislation next year. For the Democrats, Sen. Ernest Hollings (D-SC) has been Chairman of both the full and Subcommittee for the last several years. His impending retirement will leave not one, but two new regimes to handle these chairs.
Broadband over Power Lines
Capitol Hill
Since there is no legislation on BPL pending before Congress, we have been actively networking and lobbying with key congressional staff, expressing our concerns with BPL interference problems. It should be explained up front, that although this is a major issue for amateurs and at the FCC, the buzz on Capitol Hill is primarily with those staff and Members who have direct activities associated with the committees of jurisdiction on telecom issues.
What BPL is up to on the Hill
To date, we have found that the BPL industry has been meeting on an informational basis with Telecom staff for those Members who serve on the House Energy & Commerce Committee and Senate Commerce, Science and Technology Committee. They have been providing briefings on the technology and they have also offered some field demonstrations for staff to visit (Manassas, VA). In surveying Telecom staff for all congressional offices, it appears that the BPL industry is focusing primarily on those key decision makers on Telecom issues. Therefore, if your Congressman or Senators do not serve on the committees of jurisdiction, it is likely their staff knows very little about BPL.
What ARRL is Doing on the Hill
From our meetings on Capitol Hill, it appears that the ARRL is the only organization actively lobbying members of Congress in opposition to BPL. We have found no other organization, save for 1 or 2 smaller entities that may have sent a letter, to have a presence on Capitol Hill discussing interference and BPL.
Hand Delivered ARRLs BPL Opposition and Background Paper
The ARRLs info paper entitled Broadband over Power Line: Why Amateur Radio Is Concerned about Its Deployment (see attached) was originally hand delivered to each Telecom staff for members serving on the two committees of jurisdiction. We then followed up by delivering it to all remaining 67 Senate offices and are in the process of delivering it to all House offices not included in the primary target.
Conducting Face-to-Face Meetings
Chwat & Company has been making personal visits with staff for Members of Congress who serve the two committees of jurisdiction outlining amateur radios concerns. We have found that most have very little understanding of the interference potential of BPL and the far reaching impact it may have on other users as well. Our most notable meeting was with the Chief Senate Telecom Counsel. Even he said he was only in his earliest of information gathering stage.
Seeking Assistance From Members of Congress
We have had members of Congress write to the FCC expressing concern about BPL and the proceedings being undertaken by the Commission (see attached Walden letter). In addition, during a recent broadband related hearing before the House Telecommunications Subcommittee, we provided questions for Rep. Walden (R-OR) W7EQI to ask of the BPL witness present at the hearing.
Encouraging Amateurs to Get Involved
At the request of the Board, Chwat & Company assisted in developing a packet of material for ARRL leadership to use when networking with their membership. It outlined how they could be instrumental in this fight by working with their Members of Congress. It detailed key steps in letter/email writing, phone calls, and personal meetings.
We have begun to finally receive some positive feedback on this effort from several fronts. From Capitol Hill, congressional staff are letting us know that they are starting to get letters from their amateur constituents on this topic. Also, we have begun to hear from ARRL members who have made arrangements to meet personally with their congressional represeanttives on BPL.
White House
Chwat & Company arranged for a May 20, 20004 meeting with Richard Russell, the White House associate director for technology in the Office of Science and Technology Policy to discuss ARRLs concerns about BPL and the Administrations desire to see it deployed. The delegation included ARRL President Jim Haynie, General Counsel Chris Imlay, Chief Technology Officer Paul Rinaldo, and Derek Riker of Chwat & Company. They asked the Administration to heed its own experts at the NTIA and back away from its support of BPL.
During the meeting assurances were given that interference issues would be addressed, however it was made clear that the White House intends to move forward on BPL. ARRL was able to get the White House to commit to looking into problem BPL offenders and the different technologies at play.
The meeting gave excellent visibility for Amateur Radio on the BPL issue and also provided an important intelligence gathering opportunity
Amateur Radio Spectrum Protection Act H.R. 713 & S. 537
Status
On February 12, 2003, Rep. Michael Bilirakis introduced H.R. 713, the Amateur Radio Spectrum Protection Act. The bill was referred to the House Energy & Commerce Committee and then further to the House Telecommunications & Internet Subcommittee. On June 11, 2003, the bill was included as part of a Subcommittee hearing entitled, Spectrum Needs of our Nations First Responders. Jim Haynie testified before the subcommittee and was well received.
On March 5, 2003, Sen. Michael Crapo (R-ID), along with original co-sponsors Sen. Daniel Akaka (D-HI) and Sen. Larry Craig (R-ID), introduced S. 537, the Amateur Radio Spectrum Protection Act. The bill was referred to the Senate Commerce, Science and Transportation Committee and then further to the Senate Communications Subcommittee.
These bills would require the Federal Communications Commission to provide equivalent replacement spectrum if it makes any reallocations of Amateur Radio Service radio frequency allocations.

Grassroots Effort
We have begun reaching out to specially targeted members who live in key congressional districts and asked them to meet with their congressional Representatives in an effort to move the Spectrum Protection Act this year. In addition, ARRL continues to solicit copies of correspondences sent to members of Congress. The strong stream of letters we had been receiving has dried down to a trickle at this point. We are not surprised or discouraged by this and believe it is probably either the result of: A) amateurs who have intended to write have already done so, or B) efforts are now being focused on the BPL issue.
When letters come in, we are still either presenting them to House and Senate staff personally (during our face-to-face staff meetings) or having them hand delivered with additional materials on the legislation to the attention of each person the handles telecom issues for a particular office in Congress.
Prospects
At the end of May, Rep. Bilirakis approached Telecom Subcommittee Chairman Upton and asked that he bring our bill up for a vote by the Subcommittee before the end of the year. Chairman Upton gave no firm answer either way and said he would follow up with his Subcommittee staff and the telecom counsels at the full Committee level as well. In turn, Rep. Bilirakis Chief of Staff followed up with these individuals and also received no commitment. Passage of this bill relies on the support of Chairman Upton. We believe that, should the bill come up for a vote, it would pass through the committee.
The major hurdle that remains is a concern expressed by the Committee that if they provide this exemption to amateurs, it will open the door for other groups with spectrum protection concerns to come to them seeking the same promise of compensatory spectrum.
Rep. Bilirakis has encouraged us to keep pushing forward on winning over the support of Chairman Upton and full Committee Chairman Barton through a more local/grassroots oriented approach. We are working with targeted individuals in and around their districts to set-up personal meetings with these Members and discuss our issues.
Having the current Chairman of the Senate Telecommunications Subcommittee (Sen. Conrad Burns) as a co-sponsor has opened the door to move the legislation should the House pass it. It is unlikely that the Senate will take up such an issue before the House considers the bill. Following recent practices, the Senate has deferred to the House on most non-major legislation.
Amateur Radio Emergency Communications Consistency Act H.R. 1478
Status
On March 27, 2003, Rep. Steve Israel (D-NY), along with 13 original co-sponsors, introduced H.R. 1478, the Amateur Radio Emergency Communications Consistency Act. The bill was referred to the House Energy & Commerce Committee and then further to the House Telecommunications & Internet Subcommittee.
H.R. 1478 provides the FCC with the authority to consistently apply the 1985 PRB-1 ruling to all homeowners, regardless of whether they are petitioning public land-use regulators or homeowners associations for reasonable accommodation.

There has not been much letter/email activity on HR 1478, likely due to the priority of BPL and the Spectrum Protection Act. However, the few letters that we do receive, we ensure that they are hand-delivered with a cover note and background material to the appropriate office and staff.
Prospects
As we have stated before, H.R. 1478 is an important issue, however, based on the current state of telecommunications legislation, this type of issue has much less of a chance for movement this year than the Spectrum Protection bills. In addition, with the onset of BPL, we have had to keep Members of Congress and their staff focused on the biggest priorities for amateur radio. Having too many issues before Congress can become distracting. Chwat & Company continues to seek co-sponsors for the bill; however, there is not much interest in considering this particular type of legislation at the committee level.
As for a Senate counterpart, because of the focus on BPL and the Spectrum Protection bills, getting a bill introduced in the Senate continues to be a poor strategic move. Senators are much more selective in their co-sponsorship and to have them focus on one bill, let alone two, is a major task. It is better to hold off on a Senate counterpart until the Spectrum Protection legislation is addressed and the proper attention and resources can be put forth towards a CC&R antenna related bill. With no major movement in the House expected, it would be unwise to divert support from BPL and the Spectrum Protection Act at this time.
Related Issues
Licensing Restructuring
In an effort to assist an endeavor undertaken by the Board, we arranged to have Rep. Greg Walden (R-OR) W7EQI and Rep. Mike Ross (D-AR) WD5DVR write FCC Chairman Powell to urge adoption of the ARRL's restructuring Petition for Rule Making in its entirety along with rules changes needed to put it into place in as expeditious manner as possible. (see attached request and response).
Grassroots Development
At the direction of the Board and Dave Sumner we reviewed and prepared a final report relating to grassroots lobbying and BPL organizing. These reports were based on previous recommendations that we have made to expand the networking connections of officers and members of the league in support of federal government affairs priorities. As well as discussions with other organizations that utilize grassroots capabilities. John Chwat lectures to large groups of associations and corporations on Grassroots communications and is considered an expert in the field.
The recommendations were considered by an Ad-Hoc legislative affairs committee and we assisted in answering questions and making further recommendations on the issue during conference calls prior to this Board Meeting.
Washington, DC Lobbying CD-ROM
As part of Jim Haynies plans to develop a CD-ROM outlining ARRLs role in Washington, DC, congressional and federal lobbying activities, Chwat & Company arranged for face-to-face meetings with several members of Congress and coordinated the use of the camera crew with their offices.
ARRLs Presence on Capitol Hill
Chwat & Company has made a concerted effort to maintain a visible presence on Capitol Hill on behalf of the ARRL. At a rate of at least 20 meetings a month, Chwat & Company has lobbied in support of H.R. 713, H.R. 1478, and S. 537.
A special emphasis has been placed on meeting with congressional staff who have a direct impact on ARRL legislation at the Committee and Subcommittee levels. We also try to make face-to-face meetings for offices in which we have been copied on a constituent letter.

2004 Summary
As part of its services to ARRL, Chwat & Company provide monthly monitoring of state legislation which may be of interest to the League. So far in 2004 Chwat and Company reviewed nearly 1000 bills introduced by state legislatures which had key word hits in areas of interest to the League. HB 873, introduced on January 14, 2004, requires all municipalities with a population greater than 50,000 to establish an alert and warning system, including outdoor warning sirens, capable of disseminating adequate and timely warning to the public in the event of an emergency or threatened disaster. The bill was sponsored by Rep. Marian Van Landingham (D-45). It was amended to state further that the governing body of the locality, in consultation with its local emergency management organization, shall amend its local emergency operations plan that may include rules for the operation of its alert and warning system, and should include amateur radio.
Hawaii HB 2773 and HB 2774
Introduced on January 28, 2004 by Rep. Ken Hiraki (D-28), these two bills contained some of the most progressive amateur radio accommodation language in the nation. Chwat & Company worked with the sponsors staff to generate support for the bill in Hawaii. The ARRL also contributed written testimony on these bills which was submitted during a Committee hearing before the Hawaii House of Representatives (see attached).
HB 2773 was approved by the legislature nearly in tact from its original intent. The bill provides authority to permit licensed amateur owners to install antennas for amateur radios in their apartments and common elements as long as it does not alter or diminish the safety or structure of the building. However, the bill does was changed to provide a mechanism for apartment/condo boards to deny such installations so long as they are done in writing.
HB 2774 originally sought to allow amateurs living in CC&R covered communities the ability to install antenna and related equipment on their property. After moving through the legislature, the final bill was approved which provides that the board of directors of an association shall have authority to install amateur radio antennas in their units located in agricultural districts. The agriculture districts are extremely limited and fall short of the original intent of the bill.
As of the drafting of this report, these two bills were marked with an Intent to Veto by the Governor. Such a move means that the bills will be vetoed and not become law. The Legislature may either pass the bill, overriding the Governor's veto, or amend it to satisfy the Governor's objections.
