12 JUL, 2004 - 1500 CDT We need to find which track out of the "City of Truth & Light" Michael Powell's PBL special will be routed. Then we need to organize a crew to tear up the %&*&%$!!@!#@~) track! And if there is more than one potential track, tear up all of them - or at least pull enough rail spikes and unbolt enough fish plates to spill the damn train. Because BPL strategy going forward is an issue on deck for this Board meeting, I thought it necessary to share with you the "wisdom" of Bill Cross (yes, I realize what I am saying here) with respect to the timetable for BPL. While Bill isn't a paragon of useful information, he does have his ear to the ground on BPL and is no fan of OET, that is certain. I called him this morning to pry loose from him any information I didn't otherwise have about pending junk at WTB. I usually do this prior to Board meetings to prevent being blindsided while we are in Connecticut. This time, he didn't have anything new to report (with one minor exception, not now urgently relevant) but he did tell me that the scuttlebutt from OET is that (1) the Chariman is leaving in the Fall, perhaps even before the election, and (2) as his swan song, he wants to have BPL out on the street by "either September or October" at an FCC open meeting. Therefore, the FCC is in hurryup mode on BPL now. I believe that Jim Weaver is correct for a lot of reasons: delay delay delay is our best plan of action here. However, it sure is difficult to stop the train. Derek Riker is on his way to meet Walden's people today, to introduce a new Chwat staffer, and he said he would urge Walden to schedule a hearing on BPL nterference, premised at least in part on interference to public safety at low band VHF. Something to think about enroute. Chris

Of course, that would be fine with me, however, as you know to be a Chairman in D.C. you have to be real card carrying ass kisser in whatever party is in power. Richard Lee, as far as my experience with him goes, was an ass KICKER. Dick, What are you advocating??? I discussed the issue of BPL and antenna regs with our state senator (Maria Cantwell) last week. She remembered the bill we got through the Washington State legislature about 10 years ago and seems to be a real proponent of ham radio. I asked her to co-sponsor the bill and she had one of her aides call me last week about it. Hopefully making some headway here. BTW, I'm at my Vancouver house for a couple of days and can send messages to the ODV from here. Can't do this in Seattle (can receive everything but can't send anything). Will be here until tomorrow PM and most of the next two weeks. Moving to an island in Puget Sound early next month to work and probably eventually live. 12 JUL, 2004 - 1215 CDT If there is a change in leadership in the White House and a change in majorities in the U.S. Senate this fall, I would strongly suggest Richard Lee be urged to request an appointment as an FCC Commissioner and we do all we can to get him there - possibly as Chairman. Having a Commissioner who truly believes in enforcing the rules, even if it means stepping on various corporate agendas, who be refreshing to say the least and would go a long way to restoring credence to the FCC. - Dick

He had, after his debacle with Kennard, who he whistle-blew on and then got sandbagged (giving some credibility to the term "shoot to kill") tried to leave FCC to get a job in another agency, but he was branded with the letter "W" on his forehead (for "whistleblower") and got stuck at FCC. We wrote him a great letter of reference, but it didn't do any good. He has some desk job without any real duties, I think, in the Consumer Division. Chris

Richard Lee was the first federal bureaucrat I ever met who had the, um, gonads to look us right in the eye and say "The FCC has let you people down." It was in our Enforcement Task Force meeting. And then he went and actually *did* something to put things right. Plain truth coming out of an FCC mouth? I nearly fell out of my chair. It shocked one Director so bad he resigned three days later! Richard Lee was, as Joel said, the pivot-point on which the whole Amateur Radio enforcement situation turned around, and he's why the members' sharp little teeth are not fastened in our ankles about that subject any more. Since he had obviously flunked Mealy-Mouthing and Sand-Bagging 101, Richard Lee's career with the FCC didn't continue a whole lot longer. Do we know whatever became of him? 73 - Kay N3KN
