Dick, By definition, an experimental license is authority to operate within someone else’s spectrum, but no experimental license permits interfering with the service(s) authorized on the frequencies. Amateurs enjoy the benefits of experimental licenses at times, and ARRL even has been an experimental license holder at times. LF and, separately, 60 meter work was done before reallocations occurred. There are some amateurs today with experimental licenses outside the amateur allocations for various purposes. § 5.84 Non-interference criterion. Operation of an experimental radio station is permitted only on the condition that harmful interference is not caused to any station operating in accordance with the Table of Frequency Allocation of part 2 of this chapter. If harmful interference to an established radio service occurs, upon becoming aware of such harmful interference the Experimental Radio Service licensee shall immediately cease transmissions. Furthermore, the licensee shall not resume transmissions until the licensee establishes to the satisfaction of the Commission that further harmful interference will not be caused to any established radio service. § 5.85 (a) (1) Stations operating in the Experimental Radio Service may be authorized to use any Federal or non-Federal frequency designated in the Table of Frequency Allocations set forth in part 2 of this chapter, provided that the need for the frequency requested is fully justified by the applicant. < > The bottom line is that interference must be found, not just that experimental licensees have permission to operate within our bands. I have been looking for months, and there is very little out there that I could find. If I could, there are measures we would take. Specifically, I have been looking for spectrum captures or other evidence of actual interference within our bands by one or more of the HFT stations. The only spectrum capture that I had found when submitting our Opposition last week, and which I referenced therein, came from W6RB’s filing on behalf of “the Dayton Group.” The trouble, as you will appreciate, is that without organized testing, the HFT guys can be transmitting at any power and bandwidth up to the maximum authorized by their license and on a variety of frequencies that may not be those in or near ours even though authorized to do so on a non-interference basis. I also have looked at many, if not most, of the HFT experimental licenses. Some indeed have amateur frequencies included, but whether any of the experimental licensees ever transmit within or adjacent to our bands seems to be unknown. With regard to the charts that you sent ODV from David Wilson(?): did he send anything else with them, or is he available to discuss? They obviously relate to the HFT matter, but if he filed these with the FCC, I have not come across them but I am still working through the 825+ filings … 73, Dave K3ZJ David R.
