RE: [arrl-odv:16925] Evans, N3HBX Antenna Case Finally Over, Successfully

Tnx, Chris. A very interesting and, I am sure, frustrating case until its conclusion. Jim Weaver, K8JE, Director ARRL Great Lakes Division 5065 Bethany Rd. Here it is. Please keep this to yourself. I don't know where the author wants this published, but he hasn't given us the rights to it (yet). This is for your own information ONLY. Please don't redistribute it. Of course, it is only "good" NOW that the persecution is over for John Evans, N3HBX, whose big towers in Poolesville, MD are now safe from his horrible neighbors, at huge financial expense to John. We helped John with testimony and material for his briefs and Summary Judgment motion filed most recently in the nuisance part of his case, and he is appropriately grateful. Fred Hopengarten worked free for John in this case also, and good for Fred for doing so. I believe that once John's opponents saw the S/J Motion and Statement of Points and Authorities for it, they bailed on the last part of this case, the nuisance part. John had first class counsel in Steve Van Grack, a prominent Montgomery County, MD land use lawyer with great skill. It was a pleasure being examined on the witness stand by John early in this case. John's opponents were represented throughout this tortured case by the former City Counsel for Gaithersburg, MD (with whom I had tangled once before on behalf of Gene Zimmerman, W3ZZ, who got in trouble briefly with the City of G'Burg. The City Attorney was kind of a turkey at that time, and a snooty one at that. While we got Gene clear of his wrath pretty fast, I was glad to see Steve Van Grack consistently hand the lawyer crow to gnaw). So, good for John for standing his ground. John is a former COMSAT VP, now retired and (now) happily contesting. 73, Chris W3KD Christopher D.
