[arrl-odv:21081] FCC Multi-Topic NPRM

The FCC has released a Notice of Proposed Rule Making and Order in WT Docket No. 12-283, in response to an Anchorage VEC petition (RM-11629) and our "MotoTRBO" petition (RM-11625) as well as our request for a temporary waiver to permit the use of MotoTRBO TDMA equipment while the rules change is under consideration. Taking the last first, the FCC denied our waiver request (see paragraph 29) on the grounds that the waiver we had requested would not solve the problem and that ARRL had failed to submit an amended waiver request. Reviewing the chain of events that followed the submission of our petition and waiver request back in March 2011, it appears there was a misunderstanding. While an initial discussion by Chris with FCC staff of the defects they perceived in our petition and waiver request had led him to agree to submit amended versions, subsequently he understood that the issues would be dealt with in the FCC drafts and that amended filings would not be necessary. President Craigie, Chris and I have discussed the matter and have agreed that an amended waiver request will be filed immediately, even though the FCC still may not grant it. A number of the other issues contained in the NPRM are likely to be controversial and are matters on which the Board will need to develop positions.
