I'm forwarding the following E-mail because THE WRITER, W8KT, might head off the deep end and try to make a big stink that this all happened because ARRL (K8QOE and me) walked away from the situation rather than "fighting for his rights." To state the issue succinctly: 1. W8KT sought a building permit to remove his existing tower and erect three to replace it. 2. He received authorization to do this. The maximum height was on the order of 60 ft. 3. He erected three towers as the permit granted; however, a. He located them closer to his property line (neighbor next door) than was agreed. b. He made one tower 90 ft. in spite of the agreed height. 4. His neighbor protested (had been initially) so the building/zoning commission had to inspect the site and, of course, found irregularities. 5. No local attorney (including a local ham) would take his case (he would have lost). W8KT attempted to use PRB-1 as his defense. 6. As expected, W8KT has no defense against his intentional violations of the permit and has been directed to remove all three towers.. Both Joe and I and others (including a couple of Ohio ham attorneys) had advised the fellow his in intentional deviation from the provisions of the Building Permit he be lucky to come out being able to keep the three towers in any form because (PRB-1 allows local governments to dictate such specifics as "safe" locations). We offered advice in attempting to come out keeping the conditions of the initial permit and strongly encouraged him to locate an attorney so he could make the strongest possible argument to keep the towers. MORAL: Don't bite the hand of the scribe who issues building permits (or something such as this). Of course, he blames ARRL for his stupidity.
