The legislation was HR 42, "Freedom to Display the American Flag Act of 2005," and the President signed it on July 24 as Public Law 109-243. The text is on line several places, including www.govtrack.us/congress/billtext.xpd?bill=h109-42. The new law does not say that anybody who wants to can put up a flagpole. In fact, it seems like what the legislation gives with one hand it takes away with the other. The "Limitations" section of HR 42 says: "Nothing in this Act shall be considered to permit any display or use that is inconsistent with-- (1) any provision of chapter 1 of title 4, United States Code, or any rule or custom pertaining to the proper display or use of the flag of the United States (as established pursuant to such chapter or any otherwise applicable provision of law); or (2) any reasonable restriction pertaining to the time, place, or manner of displaying the flag of the United States necessary to protect a substantial interest of the condominium association, cooperative association, or residential real estate management association." Since homeowner associations are allowed to impose "reasonable" restrictions as to the manner of display, associations may be able to place restrictions on flag poles high enough to be useful as stealth antenna supports and not run afoul of the new law.
