[arrl-odv:17901] BPL Court Remand -- FCC Action imminent?

I checked today the FCC list of items on circulation, as I do periodically. I noted, somewhat surprisingly, that OET has sent to the 8th Floor for circulation on June 29 an item for the Commissioners' consideration in the BPL Docket. It looks and smells like a Further NPRM, and undoubtedly is a response to, and is solely the result of,?our Petition for Writ of Mandamus. You can see this for yourself on the FCC web page; click on the "Items on Circulation" tab in the left column. Right now, it is the third from the top on the list, but there is precious little information there. It is difficult to determine when this might be approved and released by the Commissioners, but it will probably be relatively soon since the Commission wants to avoid the wrath of the Court of Appeals. As you will see from my Board report, coming up shortly, we are ready for the FCC's inevitable defense of the 40 dB/decade extrapolation factor for BPL signal decay that the FCC has, without a shred of intellectual honesty, steadfastly maintained is reasonable.
