Ladies & Gentlemen The West Gulf Division's HB 939 was signed into law by Gov. Greg Abbott yesterday afternoon, 6.19.15. Because of the way I wrote it, it became the law of the land the instant Gov. Abbott signed it. Eight years and 4 Texas Legislative Sessions, but it is the law. It strips HOAs of the ability to prevent homeowners from installing permanent standby electric generators powered by natural gas, propane, diesel, biodiesel or hydrogen. It also places the burden of proof on the HOA in any dispute with a homeowner. It passed the Texas House by 140-0 and the Texas Senate by 31-0. The solar panel and flagpole (aka, "verticals") bills — also stripping HOAs of the right to prohibit either, were passed in previous Legislative Sessions.
