ODV, We intend to seek changes to the FCC staff draft of this Order. Outline of FCC Draft Decision on Amateur 3.3 – 3.5 GHz (9 cm) Band Summary * 3.3-3.5 GHz Amateur secondary allocation to be deleted in its entirety, subject to a phased withdrawal described below. * “Incumbents” permitted to continue operations until licensing to commercial interests (presumably 5G) commences (estimated by FCC to be approximately 90 days after spectrum auction is completed). * No alternative spectrum proposed for amateur operations. 3.45-3.5 GHz * DoD having concurred, 3.45-3.55 will be teed up for a spectrum auction expected to commence by the end of 2021. This would mean amateurs would be required to cease all operations 3.450 and above by approximately mid-2022, based on the FCC estimate. (Delays are not unusual; mid-2022 would be earliest practical, slippage to end of 2022 or some time in 2023 would not be unusual.) 3.3-3.45 GHz * Band 3.3-3.45 GHz not immediately available for reallocation and auction. Additional work with DoD needed. Timetable for transition therefore uncertain and dependent on future events. * Amateur operations permitted to continue in the 3.3-3.45 GHz segment until new rulemakings conclude with a spectrum auction and commercial licensing, as above. * Same rules to apply to 3.3-3.45 GHz operations: after auction, when FCC starts licensing entire band in all geographic areas to be vacated by radio amateurs. (TO BE CLARIFIED WITH FCC STAFF) This morning I received a draft letter from California’s Office of Emergency Services that will be very helpful, as well as information from several amateurs on their network being used in conjunction with the California fires.
