The attached memo was prepared by CEO Sumner and myself with a good deal of helpful assistance from Director Frenaye (who brought the issue to the EC in the first place) and from President Craigie. It is submitted to you pursuant to the Executive Committee's instruction at item 4.1.3 of the March 9, 2013 EC meeting, which called for the submission of this memo to you not later than June 30. The memo, at the end, prior to the exhibit, includes a series of options you may wish to consider. They may not be exhaustive but should provide a basis for discussion. There has been a request by at least one Director who is not a member of the EC to review this memorandum. Please, therefore, consider whether or not you would have the memo circulated to the full Board. It has not been circulated other than to the EC members and Director Frenaye to date. Please also note that there is a July 8, 2013 deadline for comments in RM-11699 (a Petition for Rule Making) which pertains to encryption of Amateur Radio communications. The petition in its entirety is attached to this memorandum. Our normal practice would be to file no comments on a Petition for Rule Making not dealing with spectrum allocations, such as this Petition. If, therefore, the Committee wishes to take some action on this petition at all, it will be necessary to instruct Mr. Sumner and myself to do so by vote of the EC.
