[arrl-odv:18893] ReconRobotics; ARRL Reply to Opposition to Petition for Reconsideration

Greetings. following advance review by the Executive Committee and helpful edits from Dave Sumner and various members of the Executive Committee, I filed the attached Reply to Opposition to Petition for Reconsideration this evening. I am filing this in hard copy tomorrow with FCC (the double filing being necessary due to the failure of the FCC to update its rules for Reconsideration pleadings). This closes the pleading cycle for now, though ReconRobotics just filed a second opposition to reconsideration petitions filed by others. Once again, we do not expect that the Commission will reverse itself on this waiver. However, we have already achieved in essence what we expect to get out of this; ReconRobotics has conceded that the notices that the FCC fouled up in its order in this proceeding are flawed and they do not oppose our replacement wording. Furthermore, ReconRobotics has pretty much stepped in it by staying mum on the "hand in the cookie jar" illegal pre-waiver marketing of its product. I think this is a mistake. And it appears that our complaints about ReconRobotics to FCC have been acted on, because they are admitting that an enforcement proceeding has been commenced against them. We won't know the outcome of this for some time, probably. Let me know any questions you have, but let me know them after April 25. I am going on vacation on Saturday and will be away from e-mail the entire next week. 73, Chris W3KD Christopher D. Imlay Booth, Freret, Imlay & Tepper.
