[arrl-odv:18001] FCC ET Docket No. 09-36

Greetings. Today (the due date) after review by the Executive Committee, I filed the attached comments in response to the FCC's Notice of Proposed Rule Making, released March 20, 2009, proposing to permit implantable neuromuscular microstimulation devices in portions of the 70 cm band. Brennan Price and I had met with the Alfred Mann Foundation, the proponent of this allocation some time ago, but they subsequently failed to respond to our request that they cooperate in a firm statement that their devices would not malfunction in the presence of?nearby RF signals from Amateur Radio stations. Failing that, these comments reflect our?continuing concern about the effect on implant patients from unpredictably close Amateur Radio station operations. Other radio services affected, both above and below the 430-450 MHz band, are taking similar positions. We may have to file reply comments, we don't know yet. The reply comment date is September 10, 2009. 73, Chris W3KD Christopher D. Imlay Booth, Freret, Imlay & Tepper.
