[ARRL-ODV:10202] Re: Riley's Ruling

Here's what I told Coy earlier today, in response to a similar question. (fwd) Riley's comments did not involve W1AW. FCC rules do not give priority to the stations already engaged in communication. They require cooperation by everyone. W1AW is required to operate according to a published schedule. We cooperate by sending warnings that a transmission is about to start, in sufficient time so that anyone already using the frequency has time to arrange to QSY. W1AW does not operate under automatic or remote control. There is a live operator on duty at the station whenever it is transmitting. The story centers around some digital communications, but based on this story how will W1AW fair if we come on frequency with a bulletin our code practice and there is a QSO occurring at the time?? If I understand this correctly, we would be "at fault" for causing interference to existing communications. Any guidance from anyone?? 73 Joel W5ZN
