The following and the attachment are self-explanatory. If you have had a chance to review my memo of last week on the subject of BPL, this is a very quick rebuttal to UTC's filing dated May 4, 2011. Because the Commissioners have a BPL draft from OET on circulation, and because it appeared to us unpleasantly coincidental that the UTC filing (weak though it is) was submitted about a month or so prior to the OET draft order being released to the Commissioners, Ed Hare and I believe that a rebuttal was necessary. This is that rebuttal. Ed Hare authored most of the filing, as you will see, and since it was half argument and half technical showing, I just incorporated it into a letter over my signature. But Ed did his usual spectacular job in short order. No less spectacular was the Executive Committee's response to my short-fuse request for review and approval of the document. Thanks to all of the EC members for a quick revew and approval of this, and especially to President Craigie, EVP Sumner, VP Frahm, and Director Frenaye for helpful edits and typo-fixing. Now let's see what the level of skullduggery is at FCC these days. We will likely know very soon. This is probably the last filing we will make on this, but it remains to be seen whether time will permit Ed Hare and I to make a visit to the Chairman's office and OET about this before an Order is released.
