This is a reminder that ARRL-OD or ARRL-ODV or any other place should not be used for any discussions about pending litigation. If you have a question, an issue, general information, or anything related to a lawsuit, you should contact General Counsel Chris Imlay. In more lawyerly terms: Due to the pendency of an appeal by Mr. Joe Ames of the dismissal by the United States District Court in Eastern Pennsylvania, the Ethics and Elections Committee would remind Officers, Directors and Vice Directors that it is not proper to discuss the case, or any aspect of it, on or off the OD or ODV remailer. This advice was given to Tom Gallagher and Chris Imlay in their recent discussions with our attorneys, the Cozen, O'Connor firm in Philadelphia. Here's what Counsel Imlay sent to the Board last July

Greetings. Today we received word that a lawsuit was filed against ARRL, President Roderick, CEO Gallagher, and PSC Chair Dr. Jim Boehner in the United States District Court for the Eastern District of Pennsylvania by Joe Ames, W3JY, the former NTS Eastern Area Chair and former Eastern PA Section Manager. The complaint and summons have not yet been served on any of the defendants. Our insurance carrier has been notified. The rather poorly drafted complaint alleges that the ARRL news release about Ames' field organization appointments and the declaration of the EPA SM postiion as vacant defamed Ames.
As the result, please do not engage in any communications involving Joe Ames whatsoever. Any e-mails on the subject of Mr. Ames that you may receive should be forwarded to my office and not responded to. Any such communications are discoverable and stand to harm ARRL, and any disclosures that are made by any officer, director or vice director that reach Ames are prejudicial to ARRL.
