There's little I can add to what Chris has said in response to Dick Norton's questions. I don't recall having heard of any earlier ARRL attempts to take FCC rulemaking decisions to the Court of Appeals. When the FCC made reasoned technical decisions there was no reason to do so. Dave K1ZZ
