ARRL v. FCC, BPL Court Appeal, Oral Argument Scheduled

Greetings. We have now received an order from the Court of Appeals scheduling oral argument. We do NOT know how much time will be allotted to ARRL and how much to the FCC. That is sometimes an indicator of the interest of the Court in the case. The numbers are typically either 10, 15 or 20 minutes per side. More than 15 is rare, however. We will know that soon. In any event: Oral argument will be on Tuesday, October 23, 2007 at 9:30 AM before Circuit Judges Rogers, Tatel and Kavanaugh. Rogers and Tatel are old hands at FCC appeals, and are very knowledgeable. Kavanaugh is not often on FCC appeal panels. I will get a reading on the panel from the WilmerHale lawyers and let you know what we can expect. Anyone feeling the spirit move them to come to D.C. for this will have an interesting morning, I will assure you.
