
Greetings. Thanks to some good work by Ed Hare, edits from Kay Craigie and Tom Frenaye, and really fast review by the entire Executive Committee on virtually no advance notice, we were able to file today the attached ex parte submission in the BPL Docket. This had a short fuse because we are acting prudently here. Current Technologies, our most active antagonist in the BPL proceeding (and one of the few remaining BPL companies that is active) filed a rather aggressive ex parte filing recently. Dave Sumner and I were worried that this might signal some fast action by the FCC on the Further NPRM in the BPL proceeding. This is a real fear because the FCC has due in Congress in February a comprehensive broadband plan, and we couldn't risk letting Current's filing go unrebutted in case FCC had conspired with Current to get something into the record to try to salvage the present BPL rules. Fortunately, Ed has punched huge holes in Current's technical argument, and the rebuttal is pretty darn convincing, viewing the matter as objectively as possible. So, here it is. I sent copies to everyone that Current did. I will send the Exhibit B separately, because the server rejected the package when I sent it earlier with all exhbits.
