Not our case, of course -- ours is a long way from being argued, much less decided -- but you may find of interest this decision last Friday by a panel of the U.S. Court of Appeals for the D.C. Circuit, vacating and remanding an FCC decision.
Unlike the BellSouth case, our argument is based on technical rather than economic/competitive factors. However, the decision may provide some insight into how much (or how little) presumption of expertise currently is being accorded the FCC by the Circuit Court of Appeals.
